NOTICE OF EXCLUSIVE RIGHTS PROTECTION

1. This Notice of Exclusive Rights Protection posted on the website https://ydentity.uk/ (hereinafter referred to as the Website) reflects the policy of Ydentity Jewelry Brand (Sole Proprietor Yuliana Igorevna Ilina, hereinafter referred to as the Right Holder) regarding the ownership and use of the objects of exclusive rights posted on the Website.

2. The objects of exclusive rights placed on the Website are:

- trademarks (including, but not limited to, the trademark "ydentity")

- photographs posted on the Website, including, but not limited to, the "Jewelry" and "Collections" sections;

- video recordings, placed on the Website;

- texts posted on the Website, including, but not limited to, jewelry descriptions posted in the "Jewelry" and "Collections" sections;

- designs of jewelry as copyrights;

- designs of other goods offered for sale on the Website as copyrights;

- designs of jewelry patented as industrial designs,

- elements of jewelry patented as utility models, inventions;

- corporate style;

- other results of intellectual activity protected in accordance with the legislation of the Russian Federation and similar means of individualization.

Exclusive rights to the trademark "ydentity" belong to the Right Holder. Third parties are not entitled to use trademarks mentioned in this paragraph and (or) similar to the point of confusion for the purposes of individualization of services stores and (or) online stores, as well as for the individualization of goods - jewelry, watches, other goods, similar to the goods in respect of which trademarks are registered.

The use of the designations "ydentity" and (or) designations similar to the point of confusion with it for commercial purposes is allowed only on the terms of a license agreement (agreement) concluded between the Right Holder and the person who has the intention to use the trademark of the Right Holder. It is not allowed to use the trademarks in the absence of the license agreement concluded with the Right Holder, including the trademark "ydentity" in the following ways:

- marking of goods with the trademark;

- using the trademark in the sale of goods or in the offer for sale of goods;

- using the trademark in the design of the Internet websites and (or) online stores;

- using of the trademark in the design of retail outlets, offices, other commercial premises;

- using a trademark in advertising, including on the Internet;

- using the trademark in the design of goods and (or) their packaging;- using the trademark in any other way.

4. Exclusive rights to other trademarks posted on the Website belong to the Right Holder. Third parties shall not be entitled to use trademarks posted on the Website and (or) designations similar to the point of confusion for the purposes of individualizing the services of stores and (or) online stores, as well as for individualizing goods - jewelry, watches, other goods, similar to the goods in respect of which the trademarks are registered.

The use of trademarks posted on the Website and (or) designations similar to the point of confusion for commercial purposes is allowed only under the terms of a license agreement (agreement) concluded between the Rights Holder and the person who intends to use the Rights Holder's trademark(s). It is not allowed to use the trademark(s) in the absence of the license agreement signed with the Rights Holder, including:

- marking of goods with the trademarks of the Right Holder;

- using the trademarks of the Right Holder when selling the goods or offering the goods for sale;

- the use of the trademarks of the Right Holder in the design of the Internet sites and (or) online stores;

- the use of the trademarks of the Right Holder in the design of retail outlets, offices, other commercial premises;

- use of trademarks of the Right Holder in advertising, including in the Internet;

- use of trademarks of the Right Holder in the design of goods and (or) their packaging;

- use the trademarks of the Right Holder in any other way.

5. The Website may contain trademarks, the right holder of which is not the Right Holder. Such trademarks shall be placed solely with the consent of the right holders of the trademarks, including in connection with the creation of collections of jewelry in collaboration (cooperation) with other brands. The Right Holder does not dispose of or give permission to use the trademarks of other right holders. Exclusive rights to the respective trademarks shall be disposed of by the right holders of such trademarks.

6. Exclusive rights to the photographs posted on the Website belong to the Right Holder

Third parties may not use the photographs on the Website for commercial purposes (for profit) without prior written consent of the Right Holder.

The photographs on the Website may be quoted for informational, scientific, educational or cultural purposes that are not related to profit making. Quoting photos is allowed to the extent justified by the purpose of quoting, with the obligatory indication of the "© Ydentity" protection mark and a dynamic link to the quoted photo on the Site https://ydentity.uk/. It is not allowed to change the photographs when quoted, including retouching, framing, darkening, brightening, changing colors, applying filters, or otherwise changing them.

7. The exclusive rights for the video recordings placed on the Website belong to the Right Holder

Third parties may not use the video recordings published on the Website for commercial purposes (with the purpose of making a profit) without the prior written consent of the Right Holder.

Video clips published on the Website may be quoted for informational, scientific, educational or cultural purposes not related to profit making. Video clips may be quoted to the extent justified by the purpose of the quote, provided that the "© Ydentity" protection mark is specified and a dynamic link to the quoted video on the Website https://ydentity.uk/. No modifications of the videos, including retouching, cropping, darkening, brightening, color changing, filtering or other modification of the videos, are allowed when quoted.

8. The exclusive rights for the texts posted on the Website belong to the Right Holder.

Third parties shall not be entitled to use the texts contained on the Website for commercial purposes (for profit) without prior written consent of the Right Holder.

The texts published on the Website may be quoted for informational, scientific, educational or cultural purposes not related to profit making. Quotation of texts shall be allowed to the extent justified by the purpose of quotation, with the obligatory indication of the "© Ydentity" protection mark and a dynamic link to the quoted text on the Site https://ydentity.uk/. It is not permitted to make changes to the quoted text and it is not permitted to quote text in a manner that changes the meaning of the text and/or distorts the author's intent. It is also not allowed to use separate phrases (quotes) out of context, when this context is important for the perception of the meaning of the quoted phrase.

9. The designs of jewelry and other goods offered for sale on the Website are the objects of copyright, the exclusive rights to which belong to the Right Holder. In addition, the designs of jewelry may be patented by the Right Holder as industrial designs or registered as trademarks.

Third parties may not use the designs of jewelry and/or other goods offered for sale on the Website without the prior written consent of the Right Holder, including (but not limited to) not using the designs in the following ways:

- reproduction of the designs in finished goods (industrial or handcrafted);

- sale or offer for sale of goods in which the designs are expressed;

- advertisement of goods in which designs are expressed;

- creation of sketches of jewelry (as well as other goods) using designs;

- creation of new designs (sketches) of jewelry based on the designs of the Right Holder;

- use of designs in any other manner.

10. Separate elements of jewelry may be patented by the Right Holder as utility models and (or) inventions. Third parties shall not be entitled to use the utility models and (or) inventions patented by the Right Holder.

The use of useful models and/or inventions, patented by the Right holder, is allowed only on the terms and conditions of the license agreement (contract), concluded between the Right Holder and the person who has the intention to use such useful models and/or inventions of the Right Holder. The use of useful models and (or) inventions in the absence of a license agreement concluded with the Right Holder is not allowed; including the use of utility models and (or) inventions by the Right Holder is not allowed in the following ways:

- reproduction of utility models and (or) inventions in finished products (industrial or handicrafted);

- sale or offer for sale of goods, in which useful models and (or) inventions are expressed

- advertising of goods (including the Internet), in which useful models and (or) inventions are expressed;

- creation of new (dependent) technical solutions on the basis of utility models and/or inventions of the Titleholder;

- use of utility models and/or inventions) by any other means.

11. The website https://ydentity.uk/ is designed using the corporate identity of the "Ydentity" brand. Corporate Identity means the entirety of design works that visually identify the Ydentity brand, including individual elements of the Website, the design of the Website's catalog, the design of the Website and its pages, and the layout and design of the Website.

Third Parties may not use the Ydentity Brand Identity or any of its elements without the prior written consent of the Right Holder, including:

- use of the corporate style of the "Ydentity" brand in the design of Websites on the Internet and (or) online stores;

- use of the Ydentity brand identity in the design of retail outlets, offices, and other commercial premises;

- use of the Ydentity brand identity in advertising, including online advertising;

- use of the corporate style of the Ydentity brand in the design of goods and (or) their package;

- use of the corporate style of the Ydentity brand in any other way.

12. Infringement of the exclusive rights to the results of intellectual activity and similar means of individualization is subject to civil liability in the form of monetary compensation in the amount of up to 5,000,000 rubles (Articles 1301, 1406.1, 1515 of the Civil Code of the Russian Federation). In case of use of the results of intellectual activity and (or) means of individualization of the Right Holder without the consent of the Right Holder, the Right Holder reserves the right to address the infringers with a demand to stop the violation and demand to recover the monetary compensation in the amount up to 5 000 000 rubles at the discretion of the Right Holder. In case of failure to settle the dispute in claim (pre-trial) order, the Rightholder has the right to bring the claim to court.

13. The use of the results of intellectual activity and/or means of individualization of the Right Holder may also be considered as an act of unfair competition (Articles 14.5, 14.6 of the Federal Law of July 26, 2006 No. 135-FZ "On Protection of Competition". In case of the above mentioned unfair use the Right Holder reserves the right to address in antimonopoly authority and (or) in court with the claim about confessing the actions of the violator as an act of unfair competition and about collecting losses which were made as a result of unfair actions of the violator.

14. This Notice reflects the Right Holder's policy regarding the items of exclusive rights on the Website, it is not a public offer and does not indicate any intention of the Right Holder to conclude any contracts or agreements (including licensing or concession agreements) regarding the items of exclusive rights on the Website.

15. This Exclusive Rights Notice is valid for the entire duration of the Ydentity brand and Sole Proprietor Yuliana Igorevna Ilina. Violation of the exclusive rights to the objects specified in this Notice during the entire period of validity of the exclusive rights to such objects is a violation and entails civil liability in the manner prescribed by the laws of the Russian Federation.

16. The Right Holder has the right to change the provisions of this Exclusive Rights Notice. The new version of the Notice of Exclusive Rights will take effect from the moment it is posted on the information and telecommunications network of the Internet at https://ydentity.uk/.
